The Act is in five parts and includes provisions in Scottish law for: i) the creation of a national debt arrangement scheme to enable multiple debts to be assessed with the support of money advisers and repaid over a period of time, with the prohibition of enforcement action against the debtor during the operation of the scheme; and ii) the abolition of poindings and warrant sales, (the enforced impounding and sale of a person's goods in order to repay their debts). These provisions are based upon the recommendations of the Improving Debt Recovery Working Group in their report 'Striking the Balance: a new approach to debt management' in July 2001.
