The Commission (which is completely independent from the Scottish Prison Service) conducts reviews of prisoner complaints that remain unresolved after a prisoner has exhausted the remedies available through the internal complaints system of the SPS. The following areas are excluded from the Commission's remit: issues relating to conviction or sentence, and matters under the control of outside bodies such as the police and the Parole Board. During the period April 2004 to March 2005, the Commission received 388 complaints, 259 of which were held to be within its jurisdiction. During this period, four formal recommendations (which covered issues raised in sixteen separate complaints) were filed. The annual report includes summaries of the Commission's recommendations in ten cases.
