As part of the Scottish Executive's wider programme of land reform, the Scottish Law Commission's report contains recommendations for law reform relating to the foreshore and sea bed. This follows on from a comprehensive review of the existing law and public consultation on its draft proposals published in April 2001 (Discussion paper 113, ISBN 0108880257). It recommends that new statutory public rights should be established exercisable on the shore, foreshore, sea bed and inland waters. These, together with access rights under the Land Reform (Scotland) Act 2003, would preserve the extent of current common law rights. Recommendations are also made regarding the extent of crofters' rights to gather seaweed on the foreshore; certain rights relating to udal tenure in Orkney and Shetland; the grant of rights of port and harbour; rules of reclamation and the standard construction of deeds. The report also contains the text of a draft bill to implement these recommendations.
