These Explanatory Notes have been produced to assist in the understanding of the Prevention of Terrorism Act 2005, Elizabeth II - Chapter 2 (available below). The purpose of this Act is to enable 'control orders' to be imposed on individuals suspected of being involved with terrorist activities. These orders could be used to restrict a person's freedom movement, association or communication and are designed as a preventative measure.

There are two types of orders: non-derogating (that do not involve derogating from the European Convention on Human Rights), and derogating. Non-derogating orders will be made by the Secretary of State, after seeking permission from the court (although in cases of emergency the Secretary of State can make an order first and then refer it to the court for confirmation). Derogating orders will be the subject to full hearings by the High Court or Court of Sessions, with a right to appeal.
